Decision (CFSP) 2022/1968 on a European Union Military Assistance Mission in support of Ukraine

WHAT IS THE AIM OF THE DECISION?

The decision creates a European Union (EU) Military Assistance Mission (EUMAM), with the strategic objective of contributing to Ukraine’s armed forces’ (UAF) military capability to regenerate and effectively carry out operations, so that Ukraine can:

  • defend its territorial integrity within its internationally recognised borders;
  • effectively exercise its sovereignty; and
  • protect civilians.

KEY POINTS

Training and advisory role

EUMAM Ukraine is set up to:

  • provide training for UAF and territorial defence forces at basic, advanced and specialised levels, particularly from junior leadership to company, battalion and brigade levels;
  • operate in EU Member States, with their explicit consent, until the Council of the European Union decides otherwise;
  • adapt to evolving UAF needs; and
  • have a non-executive mandate, with an advisory role only.

Training support includes:

  • operational training and tactical manoeuvre up to brigade level, including advice on live-firing exercises;
  • coordinating and synchronising training support by Member States;
  • integrating the concerns of international humanitarian law, human rights and civilian protection (including against gender-based violence), together with the ‘Women, peace and security’, ‘Youth, peace and security’ and ‘Children and armed conflict’ agendas.

Command structure, political control and strategic direction

  • Operational headquarters are at the EU’s Military Planning and Conduct Capability.
  • The mission commander is the Director of the Military Planning and Conduct Capability.
  • Political control is exercised through the Political and Security Committee (PSC), which is responsible to the Council and the High Representative of the Union for Foreign Affairs and Security Policy (HR).
  • The PSC receives regular reports from the chair of the EU Military Committee (EUMC) on the mission’s conduct, and may invite EU commanders to its meetings.
  • The EUMC monitors the proper execution of the mission under the responsibility of the EU mission commander.
  • The EUMC receives regular reports from the EU mission commander and may invite the EU commanders to its meetings.
  • The EUMC chair is the primary point of contact along with the EU mission commander.
  • A multinational combined arms training command is set up based on an existing national command and control structure in a neighbouring Member State, where training components are integrated to form units.
  • A multinational special training command is set up in another Member State to command training activities on its territory.
  • The HR ensures consistency with the EU’s external action as a whole, including military assistance for Ukraine under the European Peace Facility.

Status of EU and UAF personnel

  • The European Union Status of Forces Agreement applies to EU-led units deployed in Member States.
  • The status of the UAF personnel participating in the training is defined by an agreement between the Member States hosting the training and the Ukraine authorities.

Non-EU countries

Non-EU countries may be invited to participate, without having an effect on the EU’s decision-making autonomy. If they make significant military contributions to the mission, they will have the same rights and obligations in day-to-day management as Member States.

Project cell

EUMAM Ukraine may include a project cell for identifying and implementing projects, where appropriate, to coordinate, facilitate and provide advice on projects implemented by Member States and non-EU countries, in support of its objectives.

Release of information

The HR is authorised to release EU-classified information concerning EUMAM Ukraine, up to ‘EU-restricted’ level, to Canada, Ukraine, the United Kingdom, the United States and the International Donor Coordination Cell.

Launch and review

EUMAM Ukraine was launched by Decision (CFSP) 2022/2243 on 15 November 2022 and applies for 2 years.

  • The PSC conducts a strategic assessment of the mission and its mandate 6 months after the launch.
  • A strategic review will be conducted ‘in good time’ before the decision expires.

This decision will be repealed when the EU command and control structure closes.

Cost

The cost of EUMAM Ukraine for the 2-year period after its launch is €106.7 million.

It has applied since 17 November 2022 for 2 years.
